These Terms govern use of the Keepsake Collectables website and purchases made through it.

1. About Us

2. Acceptance

·       By accessing this website or placing an order you agree to these Terms. We may update these Terms by publishing a revised version.

3. Eligibility

·       You must have legal capacity to enter into a binding agreement.

4. Products

·       We sell genuine trading card game products and collectables.

·       Images are illustrative unless stated otherwise.

·       Availability is subject to stock and supplier availability.

5. Pricing and Orders

·       Prices are in AUD unless stated otherwise.

·       Orders are accepted only after payment is received and dispatch is confirmed.

·       We may correct genuine pricing or listing errors before dispatch and issue a refund if required.

6. Payment

·       Payment is required before dispatch.

·       Accepted payment methods are those displayed during checkout.

7. Shipping

·       Orders generally dispatch within 1–2 business days via Australia Post.

·       Standard and Express services may be available.

·       Signature on Delivery is used where offered to protect both customers and Keepsake Collectables.

·       Delivery estimates are not guaranteed.

8. Delivery, Risk and Title

·       Risk generally passes on confirmed delivery. Signature on Delivery assists in confirming successful delivery. Nothing limits rights under the Australian Consumer Law.

9. Returns

·       No change-of-mind returns for sealed collectables.

·       Australian Consumer Law rights always apply to eligible goods.

10. Trading Card Products

·       Products contain randomised contents.

·       Pull rates and grading outcomes are not guaranteed.

·       Factory seal variations, centring, print lines, minor packaging wear and other manufacturer characteristics are not defects unless required by law.

11. Pre-orders

·       Payment is taken at purchase.

·       Release dates and allocations depend on suppliers.

·       Reduced allocations will normally be fulfilled in order received. If fulfilment is impossible, a full refund or agreed alternative will be offered.

12. Fraud

·       We may cancel orders where fraud, payment irregularities or abuse are reasonably suspected.

13. Intellectual Property

·       Website content and branding remain the property of Keepsake Collectables Pty Ltd.

14. Liability

·       Liability is limited to the maximum extent permitted by Australian law.

15. Governing Law

·       These Terms are governed by the laws of New South Wales, Australia.

17. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or any other applicable legislation. Where a product fails to meet a consumer guarantee under the ACL, you may be entitled to a repair, replacement or refund depending on the nature of the failure.

Where permitted by law, our liability for goods not ordinarily acquired for personal, domestic or household use is limited to the replacement of the goods, repair of the goods, payment of the cost of replacing or repairing the goods, or supplying equivalent goods.

18. Customer Responsibilities

Customers are responsible for ensuring all order details, including delivery address, email address and contact information, are complete and accurate at the time of purchase.

Keepsake Collectables is not responsible for delays or additional costs resulting from incorrect delivery information supplied by the customer.

Customers should inspect their order promptly upon delivery and notify us as soon as reasonably practicable if an issue is identified.

19. Shipping and Signature on Delivery

Orders are shipped using Australia Post. Delivery estimates are provided in good faith but are not guaranteed.

Signature on Delivery is used wherever available to provide additional protection for both customers and Keepsake Collectables.

Once Australia Post records a successful delivery, including a signature where applicable, the order will generally be regarded as delivered, subject always to any rights available under the Australian Consumer Law.

Where a parcel is delayed, we will assist customers by lodging enquiries or investigations with Australia Post where appropriate.

20. Lost, Delayed and Damaged Parcels

If an order is delayed beyond expected delivery timeframes, customers should contact us so we can assist.

Claims relating to transit damage should include photographs of the packaging and product where reasonably possible.

Where Australia Post determines a parcel has been lost before successful delivery, we will work with the customer to determine an appropriate resolution in accordance with applicable law.

21. Pricing Errors

Despite our best efforts, pricing or listing errors may occasionally occur.

Where a genuine error has occurred, Keepsake Collectables reserves the right to cancel the affected order before dispatch and provide a full refund of any amount paid.

22. Trading Card Product Disclaimer

Trading card products are manufactured by third parties. Manufacturing tolerances and quality control standards vary between publishers and print runs.

The following characteristics are generally considered manufacturer variations and are not defects unless required by law: factory shrink-wrap variations, loose or tight wrapping, minor packaging wear, corner compression from manufacturing, centring variations, print lines, ink marks, roller lines, colour variation and other similar production characteristics.

Keepsake Collectables does not guarantee grading outcomes from PSA, BGS, CGC or any other grading service.

Randomised products are sold as sealed products only. Individual card contents and pull rates cannot be guaranteed and are not grounds for return.

23. Customer Conduct

Customers agree not to misuse the website, attempt unauthorised access, interfere with website functionality, or engage in fraudulent, abusive or unlawful conduct.

We reserve the right to refuse service or cancel orders where customer behaviour is abusive, threatening, fraudulent or otherwise inconsistent with these Terms.

24. Pre-Order Terms

Pre-order products are purchased before they are released by the manufacturer or distributor. By placing a pre-order, you acknowledge that release dates are estimates and may change without notice.

Payment is required in full at the time the pre-order is placed.

Where distributor allocations are reduced, orders will generally be fulfilled in the order they were received.

If we are unable to fulfil a pre-order due to reduced allocations or supplier issues, we will provide a full refund or another mutually agreed resolution.

Customers may request cancellation of a pre-order prior to dispatch. Approval is at the discretion of Keepsake Collectables, as inventory is often ordered specifically to meet customer demand.

25. Supplier Delays

Keepsake Collectables is not responsible for delays caused by manufacturers, distributors, freight providers or other third parties.

Where significant delays occur, we will endeavour to keep customers informed using the contact details provided at the time of purchase.

26. Order Cancellation by Keepsake Collectables

We reserve the right to cancel or refuse any order prior to dispatch where reasonably necessary, including but not limited to pricing errors, stock discrepancies, supplier shortages, suspected fraud, payment verification issues or circumstances beyond our reasonable control.

Where an order is cancelled by us, any payment received for the cancelled products will be refunded using the original payment method.

27. Website Availability

While we aim to keep the website available at all times, uninterrupted access cannot be guaranteed. We may suspend or restrict access for maintenance, upgrades, security or operational reasons.

28. Accuracy of Website Information

We make reasonable efforts to ensure product descriptions, images, pricing and availability are accurate. However, errors or omissions may occasionally occur.

Product images may differ slightly from the product received due to manufacturer updates, print variations or packaging changes.

29. Intellectual Property

All content displayed on this website, including text, graphics, logos, photographs, product descriptions, branding and design elements, is owned by or licensed to Keepsake Collectables Pty Ltd and is protected by applicable intellectual property laws.

No material may be copied, reproduced or used without prior written permission unless permitted by law.

30. Force Majeure

Keepsake Collectables is not liable for delays or failures to perform obligations where those delays arise from events beyond our reasonable control, including natural disasters, pandemics, industrial action, cyber incidents, government action, transport disruption or supplier failures.

31. Privacy

Personal information collected through this website is handled in accordance with our Privacy Policy, which forms part of these Terms & Conditions.

32. Amendments

We may update these Terms & Conditions from time to time. Updated versions will be published on our website and apply from their stated effective date.

33. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

34. Entire Agreement

These Terms, together with our Privacy Policy and any policies expressly incorporated by reference, constitute the entire agreement between you and Keepsake Collectables regarding use of the website and purchases made through it.
